Through the use of this website or the submission of an order (as well as any subsequent orders), you are indicating your agreement to the terms that are presented below.

Through your use of originalpowercoffee.com, you confirm your will to purchase services and goods from Original Power Coffee in accordance with these Terms and Conditions, which will apply to all transactions.

In order for us to be able to provide you with essential information such as Order Confirmations and changes to our service, we require that you provide us with your email address. When you sign up for originalpowercoffee.com, you are indicating that you are giving your consent for your email address to be used to provide you with such information.

When you purchase via our website, you agree to both our Terms and Conditions as well as our Privacy Policy.

The creation of an account on originalpowercoffee.com or the completion of a purchase through our website will not automatically result in you receiving emails for marketing purposes unless you freely choose to receive promotional emails. You can opt-in for marketing communication upon purchasing our products and can opt out of receiving these communications at any time if you change your mind.

 

2. PURCHASE

2.1 This website is operated by Original Power Coffee Ltd (“we”, “us”, “our”, “Original Power Coffee” or “originalpowercoffee.com”). When you use originalpowercoffee.com, you agree to be bound by these terms and conditions, including those policies referenced herein and/or available by hyperlink on our website. Any new features or tools which are added to the current store shall also be subject to the Terms of Service

At any time, these Terms and Conditions will govern any uses and purchases made on this website; however, the Terms and Conditions that will govern any particular use or purchase will be those that are in effect on the date that you place your order or make a particular use. You will be obligated to comply with any changes that we publish if you use or order products after we have made those changes public. 

Therefore, before you make any use of the site or place an order, you should make sure that you have a complete understanding of the Terms and Conditions that apply to your visit to the site or purchase. We will display the date that these Terms and Conditions were most recently updated to provide you with helpful information that will assist you in determining whether or not the Terms and Conditions have been modified since your most recent order.

1.2 We will confirm acceptance of your order either immediately on the website after you have confirmed your order, or when we send a confirmation email to the email address that you have provided to us. The purchase contract will be finalised at this point, and we will deliver to you the order in accordance with these terms and conditions.

1.3 When you agree to the 'Subscription' option for a product, you are required to make a minimum of two payments on two separate occasions. When you place your first order for a subscription, you will be charged the first fee, and then you will be charged the second fee automatically after a period of thirty (30) days has passed since the initial order. These terms are also explained to you when selecting the Subscription option on the product page; consequently, once you have placed an order for a subscription, you agree to be bound by these terms.

 

3. PRICE AND DELIVERY FEES

3.1 When you confirm your order, the price of the goods will be the same as displayed on the website. The only exception to this rule is if there is an accidental technical error, for which we will not be responsible. If you decide to make changes to your order and include additional items, you will be charged the prices that apply to the new item(s) at the time that the amended order is confirmed. We would like to bring to your attention that certain promotions may no longer be available if you make subsequent modifications to your order. This is because promotions are only available for a limited period.

3.2 There may be a delivery fee associated with every order that you place. If your delivery is subject to a delivery charge, the delivery charge will be displayed to you as a separate charge on the confirmation page before you confirm your order. The amount of any additional delivery fees that are added to your order will be determined by several factors, including the value of your order and the address where it is being delivered.

3.3 It is your responsibility to ensure that the correct shipping address is entered when your order is being processed online. If you find that the address that you have provided is incorrect, you are required to inform our team within thirty (30) minutes so that we can modify the shipping address. You can email our team at support@drinkpowercoffee.com.

3.4 If the shipping address that was provided is incorrect, and the package is then sent back to our return address, there will be an additional shipping charge so that the package can be sent out once more.

3.5 If you place an order with us before 14:00 on Monday-Friday, we will do everything in our power to ship it out on the same working day. Orders that are placed after 14:00 on Monday-Friday will be handled and shipped the following business day. All orders that are placed on a Saturday or Sunday will be shipped the following business day.

 

4. PAYMENT METHODS

    4.1 You have the option of paying with a debit card, a credit card, or through PayPal.

    4.2 The debit and credit cards that we accept correspond to the ones that are listed on our website on the day that your order is placed.

    4.3 At the time that you place your order, your card issuer will be contacted to request authorization for payment for your order. At the time that you place your order, we will "debit" your card with the total amount that you have paid for your order. We reserve the right to terminate our agreement with you if we are denied the authority to proceed with payment or if we have a reasonable belief that payment will be refused at any point in time.

    4.4 Delivery Charges are not included in any of the product prices that are listed on our website. During the checkout process, a Delivery Charge will be applied to your order, unless your order is eligible for free delivery.

     

    5. DELIVERY

      5.1 The address that you have provided during the process of placing your order on our website will be the one to which the delivery will be made. If you find that the address that you have provided is incorrect, you are required to inform our team within thirty (30) minutes of the discovery of this error so that we can modify the shipping address. Messages should be sent to support@drinkpowercoffee.com

      If you would like to alter the address that is associated with your subscription, you can do so through your account. There are certain areas in which we reserve the right to restrict deliveries, and this includes the right to completely remove certain areas from our list of delivery options.

      5.2 If the goods that have been delivered to you are missing, damaged, or contain incorrect goods, you are required to notify us as soon as possible. We will then make arrangements with you to return the goods to us (please note that the goods must not be used and must be in the condition in which they were received). You are entitled to return or have refunded the value (at the time of purchase) of any incorrect goods or goods which you have not received. Regardless of the circumstances, our responsibility will be limited to the price of the goods not delivered or incorrectly delivered and the cost of delivery.

      5.3 It is your responsibility to make sure that an appropriate individual is present at the delivery address on the day that the goods are delivered to receive them. On the off chance that no one is present at the address when the delivery is attempted, our courier partner will keep the items in their possession. We will leave a notification of delivery, and if the goods have not been delivered, you will have the option to reschedule the delivery of the goods.

      5.4 We would like to bring to your attention the possibility that deliveries may be delayed or cancelled on occasion due to adverse weather conditions or other events that are beyond our reasonable control. If this is the case, we will get in touch with you as soon as we can to reschedule the location and time of your delivery. Whatever the case may be, the extent of our responsibility to you will be restricted to the cost of delivery and the price of the goods that were not delivered.

      5.5 In most cases, we will only make deliveries when there is a suitable individual who is currently available to accept the delivery. If you give us instructions to leave a delivery unattended at your location, we expressly disclaim any liability that may be incurred as a result of the delivery being left unattended for some time. Forfeiting, tampering, contamination, and the result of any temperature change are all included in this category; however, this is not an exhaustive list.

      5.6 If the address that was provided was incorrect and our courier was unable to deliver the package, we will provide a refund to the customer. The cost of shipping will not be included in the refund. If you would like the parcel redelivered, you will be responsible for paying an additional shipment cost to the correct shipment address. The invoice for this cost will be sent directly from Aline & C Ltd., and it will be required to be paid before the shipment is made.

       

      6. DEFECTIVE OR FAULTY GOODS

        6.1 We guarantee that the products we sell are of the highest possible quality. You must inspect the products and any dissatisfaction with your order must be communicated to us on time, either in writing or via email. If you notify us within thirty (30) days of the delivery of the goods, we will either arrange for the delivery of replacement goods or provide a full refund of the price of any goods that do not meet your reasonable satisfaction.

        6.2 Subject to the provisions of clause 7.1, we will not accept any additional claims for loss resulting from or in connection with the supply of defective goods, regardless of whether they are direct, indirect, consequential, or otherwise, and regardless of whether they arise after the thirty (30) days from the date of delivery has passed.

         

        7. CANCELLING ORDERS AND RETURNS 

          7.1 After an order has been placed, our goal is to start the shipping process as quickly as possible. Therefore, once we have received your order, we are unable to make any changes. This includes making changes to the delivery address, cancelling the order, and adding, removing, or exchanging items within the order. On the other hand, you have thirty (30) days after delivery to return your items and receive a refund.

          7.2 You have the right to reject your goods and to return your order to us to receive a full refund at any time up until thirty (30) days after the date of delivery, provided that you notify us via email. Kindly take note that to receive a complete refund, the items must be in their original condition and must not have been used.

          7.3 We will make arrangements with you to return the goods that were cancelled to us; however, we will not be responsible for the cost of returning these goods; you are responsible for paying the cost of returning these goods.

          7.4 We will credit your payment card with the full price of your order (including the goods and initial delivery charge) until fourteen (14) days after the date on which cancellation was originally given (provided payment has already been debited to your payment card).

          7.5 You can cancel a scheduled shipment of a subscription at any time, provided that the order has not yet entered the processing phase. To terminate your subscription agreement, you can either log into your subscription portal or send an email to support@drinkpowercoffee.com. Our team will then terminate your subscription agreement without further action from you. Subscription customers will receive a renewal reminder email before their subscription renewal date. At this point, the customer can cancel the upcoming shipment at any time up until one business day before the renewal date. However, once a subscription has been renewed and the order has been processed, it is not possible to cancel the renewed order. Unopened, unused goods can be returned within thirty (30) days and a full refund will be provided.

           

          8. LIABILITY

            8.1 Our liability for death or personal injury that is the result of our negligence, breach of contract, or breach of statutory duty will not be limited in any way by these Terms and Conditions whatsoever, nor will any of these terms limit any of your statutory rights.

            8.2 In addition to clause 5.4, we will not be considered to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance that is beyond our reasonable control. This statement applies to any situation in which we are unable to perform our obligations.

            8.3 Except for the provisions outlined in clause 8.1, our maximum liability for any order for the supply of goods to you that is made in accordance with this contract will be limited to the retail price of the goods and the cost of delivery that was included in the initial order.

             

            9. SUBSCRIPTION

              9.1 When you purchase a subscription you'll receive repeat deliveries, based on the duration of your subscription and the frequency that you choose.

              9.2 The information regarding your payment will be stored safely, and you will be charged for each of these deliveries.

              9.3 When a subscription's end date arrives, it will automatically renew itself. You have the option to cancel a subscription if you do not wish to continue with it.

              9.4 If you wish to modify or terminate your subscription, you are free to do so at any time. You will find links to your order in the emails that confirm your order, and you will be able to manage your subscription from there. Please do not hesitate to contact us at support@originalpowercoffee.com if you are experiencing any difficulties when using our service. Please refer to our returns policy for further information regarding refunds and returns.

               

              10. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

                10.1 If you send certain specific submissions (for example, contest entries) or if you send creative ideas, suggestions, proposals, plans, or other materials, whether online, via email, via postal mail, or in any other way (collectively referred to as "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you send to us. This includes the ability to use them and modify them in any way. There is no obligation on our part to (1) keep any comments confidential, (2) compensate any comments, or (3) respond to any comments. We are not and will not be under any obligation to satisfy any of these requirements.

                We may, but are not obligated to, monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party's intellectual property or these Terms of Service. However, we may do so.

                You acknowledge and agree that your comments will not infringe upon any specific rights of a third party, including but not limited to copyright, trademark, privacy, personality, or any other personal or proprietary right. You further agree that your comments will not contain any material that is libellous, unlawful, abusive, or obscene in any other way, nor will they contain any computer virus or other malware that could in any way affect the operation of the Service or any website that is related to it. Not only are you not permitted to use a fictitious email address, but you are also not permitted to pretend to be someone other than yourself or to mislead us or any third parties regarding the origin of any comments. Any comments that you make, as well as the accuracy of those comments, are solely your responsibility. We are not responsible for any comments that you or any other third party may post, and we do not assume any liability for those comments.

                 

                11. PRIVACY

                  11.1 We place the utmost importance on protecting your privacy. Every effort is made to maintain the confidentiality, care, and safety of the personal information that you provide to us. Unless you specifically agree otherwise, we will not sell or release this information to third parties to market their products or services. Please refer to our Privacy Policy, for additional information regarding how we handle and use your data.

                  11.2 When you register for the service, you will be required to choose a password. If you fail to keep the confidentiality of your password, you are solely responsible for the consequences. By using your email address, you are responsible for any orders that you place with us as well as any information that you provide to us. If your e-mail address and/or password are used without your permission, or if you become aware of any security breach, you are obligated to immediately inform us.

                   

                  12. COMPLAINTS

                    12.1 We may make mistakes on occasion; therefore, if you feel that we have made a mistake that is not to your liking and you have a complaint, please send it to us via email at support@drinkpowercoffee.com.

                    12.2 If you are dissatisfied with the quality or condition of any of the products that you have purchased from our website, please send any complaints to us directly through email at support@drinkpowercoffee.com. There is a possibility that a confirmation of the order and evidence of delivery will be necessary to process any refunds that may be applicable.

                     

                    13. SPECIAL OFFERS AND PROMOTIONS

                      13.1 We reserve the right to make special offers for our products or services at any time, and those offers are entirely up to our discretion. The terms of any special offer that applies to your purchase will be subject to these Terms and Conditions if such a special offer applies to your purchase.

                      13.2 We reserve the right to modify the terms of special offers at any time and without prior notice, or to completely withdraw them from promotion.

                      13.3 It is important to note that any promotional discount is only applicable to the initial recurring payment for the one-month subscriptions; it does not apply to subscriptions for three, six, or twelve months.

                      13.4 Combining discount codes is not permitted. Only one coupon code can be used for each purchase.

                      13.5 Free shipping on orders over 60 pounds is only applicable to mainland UK.

                       

                      14. JURISDICTION

                        14.1 These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.

                         

                        15. GENERAL

                          15.1 If any of these Terms and Conditions are deemed to be unlawful, invalid, or unenforceable by any court of law, this will not have any impact on the validity of the remaining Terms and Conditions, which will continue to be valid and enforceable to the greatest extent that the law permits.

                          15.2 Any copyrights, trademarks, and other intellectual property rights that are associated with any content or material that is provided as a part of this website shall at all times remain the property of Aline & C Ltd. or our licensors. You are only permitted to use the material data and content for your personal use when placing orders through originalpowercoffee.com. Other than that, you are not permitted to copy, reproduce, publish, display, distribute, commercially exploit, use, or create imitative works of any content on the originalpowercoffee.com website without first obtaining our prior written permission. Any unwarranted use of the data and content that is posted on Original Power Coffee’s website may result in the imposition of a fee by the organisation.

                          15.3 You are responsible for checking the labels of the products you purchase to ensure that the ingredients and nutritional content are appropriate for your needs, whether they are related to your diet or allergies.

                          15.4 If additional dietary information and advice is important to you, please do not hesitate to get in touch with us directly. We will do everything in our power to ensure that you are completely at ease when using the products. Alternatively, you should discuss the matter with your physician or other medical practitioner to determine whether or not the products are appropriate for your dietary requirements and/or restrictions.

                          15.5 Original Power Cofee will occasionally offer special discounts or offers on its products or delivery charges. The company reserves the right to withdraw such offers at any time, in which case such offers and discounts will no longer apply.  This applies to any promotions and advertisements.
